Erlangly End User Licence Agreement

The terms you accept when you install Erlangly, on any plan.

This agreement is between FrontLine Software Solutions Inc., a Canadian federal corporation ("we"), and the organisation that installs or uses Erlangly ("you"). By installing or using Erlangly you accept it on your organisation's behalf.

1. What you may do

We licence you to install and use Erlangly for your own organisation's internal operations: planning and running your contact centre. This includes work you do for your own clients.

The licence isn't exclusive, and you can't transfer or sublicence it. You get it for the plan you choose:

  • Free: self-hosted, up to 25 active agents. It doesn't expire.
  • Trial: 30 days, all features, unlimited agents and up to 5 people signing in.
  • Paid: the number of active agents on your licence key, for the term on it.
  • Perpetual: the version you bought, for good. Updates are covered for as long as your Updates subscription runs.

An "active agent" is a person on your roster marked active. Signing in is free.

2. What you may not do

You may not:

  • Copy, share, sell, rent or lend Erlangly, or run it for anyone else, including hosting it as a service for other organisations.
  • Change, get around or remove the licence key check, or use more active agents than your plan allows.
  • Reverse engineer, decompile or disassemble Erlangly, including its compiled core, except where the law allows it despite this agreement.
  • Use Erlangly's rule packs, holiday calendars or other data outside Erlangly.

Erlangly's source code is readable in the software you install. Being able to read it gives you no rights beyond this agreement.

3. Your data

Your data is yours. It stays on your server. We don't collect it, and Erlangly sends nothing about your use of it to us.

The only exception is a daily update check, which asks us for the latest version number and which you can turn off. Email and other connections go only where you set them up to.

You're responsible for your server, backups and security, and for having the right to process the personal information of the people you schedule.

4. Labour rules

Erlangly's labour-law rule packs help you follow the law. They aren't legal advice, and they may be incomplete or out of date. Packs marked "beta" haven't had a legal review.

You're responsible for your schedules following the laws that apply to you. Check the rules against the law where your people work, and adjust them in Erlangly where needed.

5. Updates and support

While your licence or Updates subscription is current, you may install new versions and rule-pack updates. Support is as described in your plan.

6. Fees

Paid plans are billed as described at erlangly.com or in your order. Fees aren't refundable except where the law requires it or your order says so.

7. No warranty

Erlangly is provided "as is". To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We don't promise it will be free of errors or interruptions.

8. Limit of liability

To the extent the law allows:

  • We aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill.
  • Our total liability under this agreement is limited to the fees you paid us for Erlangly in the 12 months before the claim, or CA$100 if you paid nothing.

9. Ending the agreement

You can stop using Erlangly at any time. We can end your licence if you break this agreement and don't fix it within 30 days of our notice.

When the licence ends, you must stop using Erlangly. You keep your data, and you can export it first.

10. General

  • Governing law: the laws of Prince Edward Island and the federal laws of Canada that apply there. The courts of Prince Edward Island have jurisdiction.
  • Entire agreement: this is the whole agreement about Erlangly. It replaces anything said before.
  • Changes: we may update it for new versions; the version that came with your copy applies to it.
